Santa Fe Natural Tobacco Sues to Repeal N.Y. Direct Sale Ban
Santa Fe Natural Tobacco Co., which once billed its cigarettes as a healthy alternative to the major brands, sued New York State on Tuesday, saying that a recently approved ban on direct sales of tobacco products to consumers violates interstate commerce laws and is unconstitutional.
The complaint, filed in Manhattan federal court, says the ban on direct shipment of cigarettes will cause "irreparable" damage to the relationship between the Santa Fe, New Mexico-based firm and its customers. It asks for an immediate injunction to prevent the law from taking effect on Nov. 14.
A number of New York state officials are named as defendants in the complaint, including Attorney General Eliot Spitzer.
The statute prohibits the shipment of cigarettes to anyone in New York who is not a licensed cigarette tax agent, wholesale dealer, retail dealer, export warehouse proprietor, or government officer, the suit says.
